TERMS OF USE

1. SERVICE DESCRIPTION

PickleballScorer is a mobile application designed to enhance your pickleball experience through scoring, statistics tracking, tournament management, and social features. The Service provides tools for players and organizers to manage games, track performance, and connect with the pickleball community.

Our Service includes both free features and premium subscription features that enhance your pickleball experience with advanced analytics, tournament tools, and additional functionality.

By downloading, registering, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access or use the Service.

2. ELIGIBILITY

You must be at least 13 years old to use the Service. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the Service with the consent of a parent or legal guardian.

To create an account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. SUBSCRIPTION TERMS

3.1 Subscription Plans

We offer premium subscription plans that provide access to advanced features. All subscriptions are annual subscriptions with a length of 1 year from the date of purchase.

3.2 Pricing and Payment

• Subscription prices are displayed in the app and may vary by region
• All payments are processed through the App Store (iOS) or Google Play Store (Android)
• Prices include applicable taxes where required by law
• We do not offer free trials for our subscription plans

3.3 Auto-Renewal Policy

• Your subscription will automatically renew for the same duration (1 year)
• You will be charged the current subscription price at the time of renewal
• Renewal charges occur within 24 hours prior to the end of the current period
• You can manage your subscription and turn off auto-renewal in your device's Account Settings

3.4 Cancellation Policy

How to Cancel: You can cancel your subscription at any time through your device Settings:

• iOS: Profile → Pro Membership → Manage → Cancel
• Android: Profile → Pro Membership → Manage → Cancel

Cancellation Timing: To avoid being charged for the next period, you must cancel at least 24 hours before your current subscription period ends.

Access After Cancellation: You will continue to have access to premium features until the end of your current billing period.

4. REFUND POLICY

4.1 No Partial Refunds

We do not provide partial refunds for unused portions of subscription periods. If you cancel your subscription, you will retain access to premium features until the end of your current billing period.

4.2 App Store Refund Policies

• iOS (Apple App Store): Refund requests must be made directly to Apple through their refund request system. Visit https://reportaproblem.apple.com
• Android (Google Play): Refund requests must be made directly to Google through the Google Play Console or by contacting Google Play support.

4.3 Our Refund Process

While we cannot directly process refunds for App Store purchases, if you experience technical issues that prevent you from using the Service, please contact us at hello@pickleballscorer.com and we will work with you to resolve the issue.

5. ACCEPTABLE USE

You agree to use the Service responsibly and in accordance with these Terms.

5.1 Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Service for any illegal purpose
• Attempting to interfere with, compromise the system integrity or security
• Uploading viruses, malware, or other malicious code
• Collecting or tracking personal information of other users
• Impersonating another person or entity
• Using the Service in a manner that could disable, overburden, damage, or impair the Service

5.2 Content Guidelines

You agree not to post or transmit content that:

• Is illegal, fraudulent, deceptive, or misleading
• Infringes upon the rights of others
• Is defamatory, obscene, pornographic, vulgar, or offensive
• Promotes discrimination, bigotry, racism, hatred, harassment, or harm
• Is violent or threatening

5.3 Data Integrity

You agree to maintain integrity when recording match and game data. Falsifying scores or statistics is prohibited and may result in account suspension.

6. OWNERSHIP AND INTELLECTUAL PROPERTY

6.1 Service Ownership

The Service and its original content, features, and functionality are owned by PickleballScorer and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

6.3 User Content

You retain ownership of any content you submit, post, or display through the Service. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content in connection with providing and promoting the Service.

7. DISCLAIMERS

WE DO NOT WARRANT THAT:

• THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION
• ANY ERRORS OR DEFECTS WILL BE CORRECTED
• THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
• THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS

8. LIMITATION OF LIABILITY

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST TWELVE (12) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

9. TERMINATION

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

You may terminate your account at any time by contacting us or using the account deletion option within the Service.

Upon termination, your right to use the Service will immediately cease, and we may delete or deactivate your account and all related information and files.

10. CHANGES TO TERMS

We may modify or update these Terms from time to time. If we make material changes, we will notify you through the Service or by other means, such as email. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of such changes.

For significant changes affecting your rights or obligations, we will provide at least 30 days' notice before the changes take effect.
