Welcome to PickleballScorer, a mobile application designed to enhance your pickleball experience through scoring, statistics tracking, and social features. These Terms of Service ("Terms") constitute a legally binding agreement between you and PickleballScorer ("we," "our," or "us") governing your access to and use of the PickleballScorer application, including any content, functionality, and services offered through the application (collectively, the "Service").

By downloading, registering, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not access or use the Service.

2. ELIGIBILITY

5.2 Match and Game Data Integrity

You agree to maintain integrity when recording match and game data. Falsifying scores or statistics is prohibited and may result in account suspension.

6. SUBSCRIPTION AND FEES

6.1 Membership Tiers

We offer different membership tiers (Free, Basic, Premium, Pro) with varying features and benefits. Pricing and details will be provided within the Service.

6.2 Billing

If you choose a paid membership:

• You authorize us to charge the applicable fees to your designated payment method
• All fees are non-refundable except as required by law
• Recurring subscriptions will automatically renew unless canceled before the renewal date

6.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing cycle.

7. INTELLECTUAL PROPERTY

7.1 PickleballScorer Ownership

The Service and its original content, features, and functionality are owned by PickleballScorer and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

8. TERMINATION

8.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion option within the Service.

8.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

8.3 Effect of Termination

Upon termination:

• Your right to use the Service will immediately cease
• We may delete or deactivate your account and all related information and files

9. DISCLAIMER OF WARRANTIES

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT:

• THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION
• ANY ERRORS OR DEFECTS WILL BE CORRECTED
• THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS
• THE RESULTS OF USING THE SERVICE WILL MEET YOUR REQUIREMENTS

10. LIMITATION OF LIABILITY

IN NO EVENT SHALL PICKLEBALLSCORER, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
• ANY DAMAGES WHATSOEVER, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless PickleballScorer and its licensees, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.
